Circumstances beyond the control of Duke's Apartments (Force Majeure)
Except where otherwise expressly stated in these conditions, Duke's Apartments and the property owners shall not be liable, jointly or individually, for any changes, cancellations, effect on your holiday, loss or damage suffered by you or for any failure by the accommodation providers to perform or properly perform any of their respective obligations to you which is due to any event(s) or circumstance(s) beyond the reasonable control of the accommodation provider concerned (referred to as 'force majeure' in these conditions). By way of example, force majeure includes fire, flood, exceptional weather conditions, epidemics, destruction, acts of terrorism or damage of accommodation by any cause (other than negligence of the accommodation provider) and all similar situations. No compensation, expenses, costs or other sums of any description (including without limitation the cost of securing alternative accommodation) will be payable in such circumstances by either the accommodation owner or Duke's Apartments.
Apartment Appliances and Utilities
Duke's Apartments are not responsible for any failure of utilities, essential services and appliances. Please report any failures as soon as possible and every attempt will be made to contact the appropriate authorities or organise repairs. However, immediate repair may be beyond our control. No refund or discount will be deducted from tariffs for unusable appliances awaiting repair.
Our responsibility to you for your Booking of Apartment
As we have our own properties, and act as a booking agent, we have no liability for any of the accommodation arrangements (including any shortcomings or defects with or in any accommodation) and no liability for any illness, personal injury, death, damage or loss of any kind, unless caused by our negligence or that of any employee of ours.
Apartment Cancellation Policy
Full refund 14 days prior to arrival, minus fees.
Check In / Check Out of Apartment
Check in time is after 3.00 pm unless by prior arrangement. Check out time is before 10.00 am. Should you wish to extend, please contact us to confirm availability. A late check out fee may apply.
Apartment Cleaning Service Fee
Our rate includes a standard cleaning charge to cover changing linen and up to 2 hours cleaning. If the apartment requires additional cleaning when you depart, we will pass this on to you. The charge from the contract cleaners is currently at a rate of $40 an hour (double on weekends and public holidays). As a guide you can avoid this charge by following these steps:
- Remove used sheets and place in bathroom.
- Wash all dishes and return to the cupboards that they came from.
- Take all rubbish to the bins.
- Wipe down kitchen and clean grill.
- Put all used towels in the bathroom. Do not leave wet towels on the beds.
- Ensure food or dirt is not left on floor or walls.
A starter supply of toilet paper is supplied. A convenience store is located at 127 Wellington St . Alternatively a supermarket is located in Hay St, near the corner of Bennett St. Toiletries are not provided.
The guest accepts that Duke's Apartments has described the property to the best of its ability and will not be held liable should the property be deemed unsuitable on arrival.
The laws of the state of Western Australia, govern these terms and conditions. You as a renter agree to submit to the jurisdiction of the courts of Western Australia.
Apartment Guests Property
All personal belongings, luggage, vehicles and other property belonging to the Guest shall be the risk of the Guest at all times and neither Duke's Apartments or the property owners accept any responsibility for any loss or damage thereto.
Under no circumstances may the number of persons residing at the apartment exceed the maximum number of guests confirmed at the time of booking. Should this condition not be adhered to, additional charges will be incurred.
You are strongly recommended to take out adequate holiday insurance. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, all medical costs and the cost of assistance including return to your point of origin, in the event of an accident or illness.
Keys will be available on the day of arrival unless otherwise arranged. When you depart please turn off appliances, leave all sets of keys on the dining room table, and ensure the door is locked. Please note that if keys, and remote access devices, are lost or not left in the apartment when you depart you will be charged $200. This is to cover the replacement cost. There is a charge of $75 to open the door, for you, if keys are locked inside the apartment whilst you are still staying in the apartment.
Sheets, blankets, pillows, mattress protectors, towels, and tea towels are provided in the apartments. We provide quality bed linen in the apartments - please do not allow massage oil to come in contact with the sheets. The cost of replacing damaged linen will be charged to your account.
Method of Payment for Apartment
We are pleased to accept the following methods of payment: VISA, Mastercard, Bankcard.
Parking is provided for one car. Guests must only park cars in the designated area for the apartment.
Prior to your departure from our properties a Security Bond will be preauthorised on your credit card. This will not be charged to you credit card unless you have incurred additional charges. Therefore your Credit Card must be valid and contain sufficient funds to cover the bond. Please ask when booking, how much bond will be held.
Apartment Power and Cooling/Heating
These services are included in the daily tariff, however electricity use is capped at $5.00 per day per property let. Any additional charges will be charged to your credit card. Please assist by turning air-conditioning/heating off when leaving the property.
Apartment Rates and Tariff
Please note that our tariffs are subject to change and may have a loading for public holidays and long weekends. Tariffs will be confirmed on request for a quotation.
All of our properties are non-smoking. Any costs incurred with removing tobacco odours and damage will be deducted from your bond. Suitable areas are provided to smoke outdoors at all properties.
Swimming Pools are open during daylight hours. Swimming pools are available for guest use only, visitors are not permitted to use the pool. Glass containers and food are not permitted in the pool areas. The pool does not have a lifeguard and children must be unless supervised by an adult. Please respect the conditions of entry posted in the pool areas. Note: The pool at the Viscount Suite is due to be renovated later in 2008 or early 2009. This will cause some disruption to the pool area. Please let us know, when you book, if this will cause you problems.
Telephones are not installed in the apartments.
When you book accommodation through Quinby Operations Pty Ltd, trading as Duke's Apartments, you accept responsibility for the proper conduct of yourself and your party during your stay. The accommodation provider reserves the right at any time to terminate your stay or that of any member of your party due to your or their misconduct, where justified in their reasonable opinion. Full cancellation charges will then apply and no refund will be given. Furthermore, neither the accommodation provider nor Quinby Operations Pty Ltd shall be under any obligation whatsoever to pay compensation or meet any costs or expenses you may occur as a result of your stay being terminated. If your actions or those of any member of your party cause damage to the accommodation in which you are staying, you must fully reimburse the accommodation provider for the cost of the damage before you end your stay. You must also indemnify us against any claim (including legal costs) made against us as a result.
Furniture in Apartments
Please do not move furniture around in the apartments or holiday houses. Our Cleaner is generally on her own and cannot move the furniture back. We then need to arrange for 2 handy men to assist and we will need to charge the cost to your credit card.
Wireless internet access is available at the Duchess Suite. A Telstra Pre-paid Wireless modem is available to all Duke's apartments and holiday houses. A $200 deposit is required prior to delivery of the modem. This deposit is refunded on return of the undamaged modem. Access time can be purchased from Telstra through the Connection Manager that is downloaded when the modem is plugged into your laptop.
No parties of any sort, including hens, bucks, 21st & 18th partys are allowed in the apartments. We do not have the policies, procedures or resources to accommodate the unique needs of school leavers during the annual Schoolies Festival. In particular we do not have the adequate resources to engage qualified security personnel to guarantee the safety, comfort and convenience of our guests during this period. For this reason we reserve the right to reject bookings from school and/or university leavers.
If you choose to still book your accommodation through us and it turns out that you are school and/or university leavers, or planning a party, your booking will be cancelled, NO refund will be given.
If a party is reported to us offenders will be asked to leave and you risk being fined.
Our Office is bound by the Information Privacy Principles of the Privacy Act 1988. It is our usual practice to collect personal information directly from you. Sometimes we collect personal information from a third party if you have consented or would reasonably expect us to collect the information in this way, for example from publicly available sources such as websites or telephone directories. We do not collect personal information about you if you only browse this website. We do keep a record of the IP addresses of web visitors who contact us via our Contact Us webpage as well as from those who perform Availability Searches. We only use your personal information for the purposes for which you give it to us and for related, internal management purposes. We will contact you by email except in relation to a specific Booking query or confirmation you have made. We do not give information about you, to other government agencies, organisations or anyone else unless one of the following applies:
- You have consented
- You’d expect us to or we have told you we will
- It is required or authorised by law
- It will prevent or lessen a serious and imminent threat to somebody’s life or health or
- The disclosure is reasonably necessary for law enforcement or for the protection of public revenue
