Terms & Conditions of Temporary Holiday Accommodation
"Booking" means the period for which you have paid to stay at the Property. "Property" means Bilson's Landing,
Daylesford and all its fixtures, fittings and equipment. "Management" means the owners and managers of the Property.
"Guests" means the persons who stay overnight in the Property during the Booking. "Visitor" means a person a Guest permits to visit the Property during the Booking.
2. ACCEPTANCE & RESPONSIBILITY.
Payment of the Deposit constitutes acceptance of these Terms and Conditions.
3. CHECK IN/ OUT
i) Check-in time is not before 3pm on the arrival date and check out time is not later than 12 noon on departure date.
ii) Late departure is subject to prior arrangement and availability and extra charges may apply. You must notify Management of expected arrival time and a mobile contact number at least 7 days before arrival.
A deposit of 50% must be received within 24 hours after the Booking is confirmed. Bookings are not confirmed unless and until this deposit is received. Balance of the rental amount will be automatically debited 30 days prior to occupancy. If you have insufficient funds available for debit at that time you will be responsible for payment of all fees and charges. Where your stay commences in less than 28 days from the time of Booking, the full amount must be paid up front. Payment must be received no later than 30 days prior to your arrival. Payments of the amount due must be received in Australian dollars net of any bank or other transaction charges. Please ensure payments are made within the specified time limits or the Booking may be cancelled automatically without notice or liability to you.
5.CANCELLATION OR VARIATION
If you wish to vary or cancel your Booking, please contact us immediately on 0407 317 717.
i) Cancellations within 30 days of stay, money paid is not refundable unless the house is re-let for the entire period.
If a refund is made due to the property being re-let then a 25% cancellation fee will apply.
ii) Cancellations more than 30 days from your stay, money is refunded and a 25% cancellation fee will apply. Any changes to a booking will incur a $30 administration fee.
iii) The owners will make every effort to ensure the property is available as booked. However the owners reserve the
right to make alterations to bookings due to unforeseen circumstances.
iv) Should you be eligible for a refund it will be made through your chosen payment method at time of Booking.
v) A variation of the Booking which reduces the number of nights stay will be treated as a cancellation of the Booking in respect of those nights.
vi) We have a minimum nights stay policy of 2 nights, and 3 nights minimum on public holidays, special periods and long weekends. No refund will be made for a variation to the extent that it breaches our minimum nights stay policy.
6. SECURITY DEPOSIT
i) If paying by direct deposit, Paypal, Stayz Online Payment system, bank cheque or money order, a security deposit of $500 is required at the same time as the outstanding balance of your Booking. It will be credited to your designated payment method once the property has been inspected and deemed left in a similar state to your arrival. We agree to ensure this occurs within 2 working days of your departure.
ii) Any damage, loss or expense incurred by Management as a result of your breach of these Terms & Conditions will be charged against the bond. Examples of this include but are not limited to any breakage, damage or excess cleaning requirements, or extra guests beyond those declared.
iii) If paying by credit card, a credit card pre-authorisation must be provided to Management upon confirmation of your Booking.
iv) Any damage loss or expense incurred by Management as a result of your breach of these Terms & Conditions will be charged against the credit card. Examples include but are not limited to any breakage, damage or excess cleaning requirements, extra Guests or Visitors beyond those declared.
If the Property becomes unavailable for your occupancy due to unforeseen circumstances (e.g. fire, storm, damage, etc.)
then Management will inform you immediately and endeavour to obtain suitable alternative accommodation for your occupancy; failing which any moneys paid will be refunded in full.
8. PARTIES & FUNCTIONS
i) Parties and functions require prior approval at the time of Booking and special conditions will apply, including payment of a Security Deposit (as above) and a separate tariff for functions, depending on the use of the property and the number of visitors agreed to. The number of Visitors allowed is strictly by agreement in writing at the time of Booking. Guests remain responsible for Visitors attending, no disturbance of neighbours, no undue noise, silence when entering and leaving the premises, no behaviour likely to cause damage to property or offence or embarrassment to others, all noise to cease by 11pm.
ii) Breach of this condition may result in immediate termination and eviction without refund and extra charges for security, cleaning, garbage removal, wear and tear, repairs etc.
iii) Our usual tariff charged is for domestic use only and not commercial. Accordingly this rate does not allow for the extra wear associated with functions in terms of cleaning, garbage removal, wear and tear, repairs etc. Use contrary to this may result in loss of your security deposit and/or additional payments. Any variation to this condition must be agreed in writing when booking. A security deposit will apply in such circumstances.
9. LINEN AND TOWELS
We supply linen, pillows, and towels which must be left where supplied in the bedrooms or bathroom on departure.
Pets may be allowed at the Property but require prior approval at the time of Booking and special conditions will apply, including payment of a Security Deposit of $100. Pet owners are responsible for cleaning up after their pets both within and outside the property. Pets are not allowed on furniture at any time. Any evidence of pets on furniture, damage to the Property, soiling to carpets or rugs, droppings left in the yard, etc., may incur extra cleaning fees.
Pets must not be left inside the house unsupervised at any time.
The Security Deposit will be credited to your designated payment method once our property has been inspected and deemed left in a similar state to your arrival. We agree to ensure this occurs within 2 working days of your departure.
11. YOUR OTHER RESPONSIBILITIES
i) You must comply with all applicable House Rules and all instructions from Management and the caretakers of
the Property concerning occupancy, property, health, safety and quiet enjoyment of the Property and our neighbours.
ii) You are responsible for damage, breakages, theft and loss of the Property and any part of it during your stay. You must notify us of this immediately. Management may recover from you repair or replacement cost (at Management's discretion)
iii) Only the guests nominated and agreed in the Booking may stay in the Property overnight. If any other guests stay extra charges may apply or the agreement may be terminated without refund.
iv) Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund and extra charges may be made for security and other expenses.
v) Before departure, all food must be removed from fridges, all rubbish put in the appropriate rubbish bins provided, located outside the laundry door, and crockery and cutlery washed and packed away. The Property must be left in a clean and tidy condition.
vi) If you use the barbeque, it must be cleaned and the cover replaced. (Do not put the cover on a hot barbeque. Please wait until it cools before replacing the cover.) Failure to clean the barbeque after use will incur a $50 excessive cleaning charge.
vii) Extra cleaning charges may be incurred for the cleaning of dirty dishes, barbeque, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc. Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee which will be deducted from the security bond or charged to your credit card.
viii) All furniture and furnishings must be left in the position they were in when you arrived.
ix) The property should be vacated on time and secured. All windows are to be closed and external doors locked. All lights, heaters and appliances must be turned off.
x) Smoking is not permitted inside the Property.
xi) Bilson's Landing is in a residential area. Please respect our neighbours by ensuring that music is not playing on the balcony after 11pm, and that noise is kept to a minimum after that time.
12. PROBLEMS OR COMPLAINTS
i) In the case of any problem or complaint, you must inform Management at the earliest opportunity so Management has the chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours.
ii) Any complaint, which cannot be resolved locally, must be notified in writing to Management prior to departure from the Property.
iii) Failure to follow this procedure this may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have.
We recommend that you consider the purchase of travel insurance, since we are not responsible for any injuries, illness or accidents during your stay, loss or damage to property, or circumstances that prevent you from taking up your booking at Bilson's Landing.
14. SUITABILITY FOR CHILDREN
Important: Bilson's Landing is not childproof. There are stairs, a gas log fire, balcony, and unlocked kitchen cupboards and drawers. Bilson's Landing is suitable for children over seven years old. Management takes no responsibility for accidents, illness or injury to guests or visitors or their children.
