TERMS AND CONDITIONS- Seaview at Henley 3/385 Seaview Road Henley Beach

To maintain a good standard for our guests we require certain conditions to be complied with. We appreciate most will respect our property but the occasional abuse requires that we state the following conditions. Upon receiving your deposit it is a confirmation that you have read and agreed to the terms below.

The rental contract is between the guest and the owner of the property to which the accommodation booking is made and is subject to the terms and conditions herein. The contract for accommodations shall not be affected until the Owner sends the guest confirmation of the booking. The guest acknowledges that the Owner acts as a booking agent.


The Owner will not confirm the accommodation booking until the guests deposit payment is received and cleared. If the accommodation booking is made within 28 DAYS of the date of commencement of the guest’s proposed holiday, the full rental payable for the Property is required together with any bond and any other payment applicable.


The full amount payable in respect of the property rental shall be paid at least 28 DAYS prior to the date of commencement of the booking. If the full payment has not been received by the booking Manager at least 28 DAYS PRIOR to the start of the rental period, then the Booking Manager and the Owner reserve the right to cancel the booking without notice and will forfeit the guest’s deposit which will be non- refundable in such circumstances.


In the event of a booking being cancelled the deposit will be forfeited. Where cancellation is before (more than) 28 days before the date of entry 25% of the hire cost will be payable. If the booking is cancelled 28 days or less prior to the stay no monies will be refunded


All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and the Owner accepts no responsibility for any loss or damage thereto. To the full extent permitted by law, the owner is not liable for any damage or loss to any property, or injury to any person.


The guests shall be responsible for the Property during the Guest’s stay. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition. The Guest shall be liable for any breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest’s occupation of the Property and all costs of repairs and replacement thereof shall be payable to the Owner upon demand. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the Owner as soon as practicable after the damage occurring thereto.


Usage - the premises are let for holiday purposes ONLY and only for the period stated with the owner/agent. NO weddings, parties, or large gatherings are allowed. The number of people occupying the premises must not exceed the number of people that were initially booked and/or had beds provided for. OVER CROWDING OF PROPERTY, LOUD MUSIC, UNRULY BEHAVIOUR and EXCESSIVE NOISE will not be tolerated and guests will be evicted from the property and no refund of monies granted.


The property is to be left in the state that it was found, with floors swept/vacuumed and dishes washed. All rubbish must be emptied into the bins and put in the bin located in the rear courtyard area (blue lid bin is for general waste and yellow lid bin is for recycling). Any excess rubbish that won’t fit in the bin must be removed from the property or a rubbish removal fee will be charged to you. Beds must be left with quilt covers straightened and clean. Please ensure if you use the BBQ it is cleaned otherwise a $50 cleaning fee will apply. As part of the agreed price for your stay we allow 2 hours for cleaning. Any extra time required by the cleaner will incur a cleaning fee of $48 per hour and this will be payable to the owner on demand.


The Guest acknowledges that the Owner has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and the Owner and the Owner shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.


All information in respect of the Property contained in the Owner’s advertising is believed to be correct at the time of printing, however all details presented at the time of booking are subject to change by the Owner without notice. The Owner will not accept any responsibility for any alterations to the Property or any part thereof beyond the Owner’s control or any liability of any matter or occurrences beyond the Owner’s reasonable control including damage caused by extreme weather conditions breakdown of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.


The short-term accommodation contract negotiated by the Owner and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control of the Owner which renders the Property uninhabitable (for example flood, fire, storm etc... then the owner reserves the right to cancel the booking.


The Guest and the Owner acknowledge and agree that the Rental Agreement to which these conditions apply is bona fide entered into for the purposes of conferring on the Guest a right to occupy premises for a holiday within the meaning of Section 5 (2) (e) of the Residential Tenancies Act 1987 as amended (“the Act”) and the parties to the Agreement confirm that the provisions of the Act shall not apply to the Rental Agreement.


Towels and linen are provided for the number of guests stated on your booking. All quilts, pillows & bath towels are not to leave premises. Turkish beach towels are provided for beach use and can be found in the laundry cupboard.


All keys must be returned. There will be a charge if they are lost, missing or keys not returned. They can be left on the kitchen bench as you vacate the property – please leave via the front timber door and ensure that it locks behind you. It is important that all doors be locked when checking out.
