BOOKING TERMS AND CONDITIONS
Please read these terms and conditions carefully as these conditions incorporate the basis on which bookings for My Darwin Hotel are accepted.
My Darwin Hotel Pty Ltd (“ACN: 161 843 269”) Trading as My Darwin Hotel and
My Darwin Property Management. The terms and conditions below are for all bookings.
The terms and conditions of My Darwin Hotel accommodation, as agreed to by both parties, are as follows:
BOOKINGS $ QUOTES
Reservations are subject to availability and actual pricing at the time of booking.
Verbal quotes are valid for 24 hours only. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of booking.
You agree to pay the rate for each night of your stay and any additional charges up until the time you have departed the accommodation.
The accommodation may be occupied by you only for the period stated on the booking confirmation.
To book accommodation you must be aged 25 years and over. Photo ID may be required prior check in. If no photo ID is produced MDH reserves the right to cancel the booking and is under no obligation to refund any payment related to the booking.
A 50% deposit is required to secure and confirm your booking and must be paid within 24 hours.
Payment of deposit indicates acceptance of the booking Terms & Conditions.
The balance of payment must be received at least 21 days prior to the arrival date.
For bookings made inside 21 days prior to check-in, full payment is required at time of booking.
GST is not applicable.
If deposit or final payment is not received by the due date, My Darwin Hotel reserves the right to cancel the booking.
Credit card details will be required at time of booking and may be used to cover incidental items such as (but not limited to) any breakages, damage or losses incurred during your stay and cleaning charges in excess of the normal level of cleaning.
Credit card details will be destroyed after the departure clean and inspection of the property, if no claims are to be made.
Any claims will be automatically deducted from the credit card and you will be notified at the time.
For longer length of stays a security deposit ranging from 2 to 4 weeks based on the weekly rate will be required. If there are no breakages, loss or excessive cleaning the security deposit will be released in full 7-10 days after departure.
Payments are accepted by credit cards via Pay Pal.
Payments can be accepted via direct deposit.
All payments are only accepted in AUS dollars.
RATES & CHARGES
Rates quoted are in Australian dollars and are subject to change at any time.
GST is not applicable.
Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the booking.
Minimum length of stay restrictions may apply to certain rates during special event periods.
The price of your accommodation cannot be guaranteed until the deposit is received or if booking online full payment is required.
CANCELLATION TERMS & CHARGES
The following cancellation fees will apply.
If a guest cancels a confirmed booking ninety (90) days prior to commencement of the stay, the deposit will be returned in full.
If the guest cancels within ninety (90) days prior to the commencement of the stay 30% of the entire booking will be retained.
If the cancellation is less than eighteen days (18) days prior to the agreed check in date, 100% of the entire booking tariff will be retained unless the accommodation is re-booked for the total period of the occupancy.
Notification must be in writing or email and confirmed delivery is the responsibility of the guest.
In most cases, children’s prices for accommodation are included in the standard tariff rates and refer to children using existing bedding. Additional charges will apply if port-a-cot is required.
Some My Darwin Hotel properties may not accommodate children. Please check the website or call us for details.
In the unlikely event of a situation whereby My Darwin Hotel cannot provide accommodation as previously confirmed, for whatever reason, My Darwin Hotel will undertake to relocate guests into an alternative property of equal or better grading at no expense to the guest. Should there not be a property of equal or better grading in the vicinity of the original booking, it may be required to provide guests with a property of a lesser grading. If this is the case, any reduction in costs will be refunded to the guest.
The alternatives offered are at My Darwin Hotel discretion. Should the guest wish to choose a property of a standard other than that offered under this condition, then the guest will be required to pay any difference in price between the My Darwin Hotel recommended property and their own choice of property.
If My Darwin Hotel is unable to provide alternative accommodation the accommodation price will be refunded.
NUMBER OF GUESTS
At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given. The use of extra beds other than the number booked will attract an additional tariff. Any persons exceeding the maximum occupancy of the property will be considered trespassers and will be evicted.
CHECK IN & CHECK OUT
Your accommodation is available from 3.00 pm on the day of arrival and is to be vacated by 11.00 am on the day of departure. An additional fee will be charged if you do not check out by 11.00 am.
Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure early check-in or late check-out is to book an extra night.
Early arrivals and late check outs are at the discretion of My Darwin Hotel Management and must be requested at the time of booking and can only be confirmed 1 day prior to arrival or departure.
Extra cleaning and linen change can be arranged for an additional charge, at a cost to you. Contact My Darwin Hotel Management for further details.
On departure your accommodation is to be left in a clean and tidy state. Extra cleaning charges will apply if this condition is breached and will be deducted from your deposit or credit card. The cost of a standard clean, which varies from property to property, is included in the tariff charged.
Barbeques that are not cleaned by the guest on departure, attract a fee of $60 charged to a credit card.
All properties are fully self-contained which includes linen (sheets, pillow cases, towels, pool towels& tea towels) unless specified otherwise.
A replacement cost will be incurred for any linen that is permanently stained by, but not limited to, hair dye, bleach, fake tan, permanent ink.
Smoking inside any My Darwin Hotel properties is strictly prohibited. If there is any evidence of smoking inside, your booking may be terminated and you will be charged for a specialised clean to eliminate odours.
Please ensure doors and windows are closed if smoking on balconies or in courtyards.
No pets are permitted, unless the property is designated ‘pet friendly’.
In the case of ‘Pet friendly’ accommodation, a $50 per animal per stay is charged and a pet clause agreement signed. Upon departure of these properties all dog droppings must be removed from the premise and disposed of properly. If this does not occur a cleaning fee may be charged to the guest.
If pets, which have been approved, are found inside the premise, the booking will be terminated and the guests will be asked to vacate with no refund made.
If pets, which are unapproved, are found on the premises, the booking will be terminated and guests will be asked to vacate with no refund made.
Any pest control required as a result of a pet inside and/or on the premise will be charged to the guest.
Unruly or loud (barking) behaviour will not be tolerated. If complaints are received this may result in termination of the booking and loss of unused balance of accommodation.
You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupants personal property left on the premises and agree that you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.
We strongly recommend you purchase comprehensive travel insurance at time of booking. We suggest that the policy should include, but not be limited to, the reimbursement of any monies paid in the event the travel is cancelled; loss or damage to personal baggage and loss of money and medical expenses.
Parties or gatherings are prohibited, unless prior arrangements have been made with My Darwin Hotel Management. Disturbance to neighbours including excessive noise is prohibited and may result in eviction without refund.
BREAKAGES AND DAMAGES
Your accommodation will be returned to us in the condition presented on arrival.
Damages or breakages of furniture or furnishings must be reported to My Darwin Hotel Management immediately.
Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest’s visitor will be charged and recouped in full from the guest’s credit card.
Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest’s credit card, or deducted from the guest’s refundable deposit.
Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. There will be a charge incurred if furniture is not returned to its original location.
MDH must be informed of any problem or complaint as soon as possible as to rectify the situation as quickly and as efficiently as possible. You must allow access to the property for service consultants to undertake repairs during reasonable hours. We will notify you and confirm the day, date and time of the appointment. We will arrange access if you are not available at the designated time.
All guests using the pools do so at their own risk. You acknowledge that we are not responsible for accidents or injuries. No diving, running or pushing in pool area is allowed.
No glassware allowed in the pool area.
LOCKOUTS & LOSS OF KEYS
Lockouts will incur a standard or after hours call out fee & loss of keys and access fobs will incur a replacement charge.
The properties are not to be used for commercial use.
You acknowledge that we do not accept liability for any injury, damage, loss, additional expenses and disruptions caused directly or indirectly by events, which are beyond our control and agree not to make any claim in relation thereto.
You agree that regardless of your length of stay in there is no tenancy or other rights created under any Landlord and Tenant laws and there are no such laws that apply to your stay.
BREACH OF TERMS AND CONDITIONS
You agree that, should you or your guests breach any of the terms and conditions:
1. You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card as payment of that loss or damage.
2. We may evict you and your guests without notice
