PLEASE NOTE YOUR DEPOSIT AND FULL PAYMENT IS ACKNOWLEDGEMENT THAT YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS SET OUT BY L&S BROOKES THE OWNERS OF BAY BREEZE
Deposits: 2 - 7 days after booking by direct deposit or internet transfer as per the Confirmation.
Final payment: Due prior to arrival as per the Confirmation.
Keys: Entry codes are issued to obtain keys from a security box at the property.
Payments: Your deposit and balance payments are directly deposited into the Owners account.
Responsibility: The Guest accepts responsibility for and agrees to indemnify the owner and Lawrence & Sueanne Brookes against any loss or damage to the premises or its contents and the guests possessions during the guest’s occupancy. The guest must report any damages, breakages or lost items including keys immediately to Jervis.
Bond: The guest is asked to provide a Security Bond of $200.00 to complete the booking. The bond is asked along with your full payment and held in the owners account. The Bond payment is yours and the owner’s security measure. The Owner is authorised to deduct from the bond the costs and expenses relating to the damage or loss caused to the premises or contents during the guest’s stay. In the event that the bond is insufficient to cover the costs and expenses of repairs, replacement of damages and/or other breaches of your occupation. S Brookes is hereby authorised to REQUEST YOU PAY THE SHORTFALL IN WHICH YOU WILL BE INVOICED TO BE PAID BY DIRECT DEPOSIT IMMEDIATELY INTO THE OWNERS ACCOUNT OR LEGAL PROCEEDINGS WILL ENSUE. A full accounting of the additional charges will be supplied from S BROOKES to you within 72 hours by invoice regarding compensation.
Inspection and Cleaning: The property is inspected immediately after you vacate the premises. It is the occupant’s responsibility to ensure that the premises are kept clean during your stay at all times and are left in a tidy manner on departure. The moving of the furniture is strictly prohibited. Please ensure that all BBQ’s and their utensils are cleaned and gas turned off. Cleaning fees of $55/hour per cleaner, will apply for failure to comply, which I hereby authorise to be deducted from the bond. You will be notified of our claim for extra cleaning. Peak season two cleaners per property are assigned. Seafood is not to be cleaned or scraps left at the property.
Bond Return: Bond payments will be refunded in full by direct deposit to your nominated bank account on the condition of no claim by the Owner. All guests will be advised accordingly of any claim being made on their security bond, by S BROOKES on the owners behalf.
Cancellations: In the event of a cancelled booking, the deposit or full payment is not refundable unless the premises are re-booked for the entire period. If we are able to rebook the premises a cancellation fee of $100.00 will be charged. No Refund will be given if the guest vacates prior to the departure date.
Peak Season, Xmas, New Years, Long Weekends and Easter bookings are non-refundable. Last minute bookings are non-refundable.
Owners’ rights: The owner reserves the right to request that his/her property be removed from the holiday listing. Should the property you booked become unavailable for whatsoever reason, S Brookes will endeavour to relocate you to a similar property. Should you not accept the alternative property (written notification required); monies will be refunded in full. Guests agree to take no action against S Brookes in the event of this happening. If no alternative property can be found a full refund will be given. Guests agree to take no action against Jervis in the event of this happening.
Arrival: The key will be available from 3.00p.m. (No early arrivals in Peak Season)
Arrival is directly at the property, once fully paid, a security code is issued for you to obtain your keys from security box.
Departure: Strictly 9.30 AM PEAK SEASON. Secure the property and return Keys to the security box.
Peak Season, Xmas, New Years, January check out is strictly 9.30a.m. Late fees will be charged.
Functions: No organised functions are permitted, Failure to comply will terminate this agreement, and you will be asked to vacate the property immediately.
Garbage: Garbage bins must be put out for garbage collection, on THURSDAY NIGHTS. Excess garbage is your responsibility, and must be removed from the property. Excess garbage removal fees will apply at a starting fee of $50 depending on the amount of rubbish needing to be disposed of, which are hereby authorised to be deducted from the bond. If the bin is full upon arrival, please notify our office immediately.
Gas Bottle: If the BBQ gas bottle requires filling, the guest is to refill the bottle, please notify the office of the cost and it will be refunded along with your Bond.
Pets: Pets permitted on this holiday property. Lawrence & Sueanne Brookes accept no liability for any injuries incurred to pets. Please ensure your pet has tick protection.
Guests Responsibility: No person on the premises shall be guilty of conduct that is a nuisance to adjoining or neighbouring occupiers. Excess noise is not permitted after 10 pm under any circumstance. Failure to comply will terminate this agreement. Guests are also responsible for any invitees conduct and actions at the property and claims will be made to the bond if deemed necessary. You must not exceed the maximum number of guests which is advertised on each properties description. Failure to comply will terminate this agreement and you will be asked to vacate the property. Plus an additional charge of $25 per person, per night will be deducted from the bond for each person exceeding the properties maximum guest limit for the period you were accommodated. The Guest agrees to allow the agent or his nominee to enter the premises to arrange any necessary repairs. Any area of the property which is found to be locked and for which a key has not been supplied is PRIVATE and not for guests use. Anyone gaining unlawful access to a private area shall be found to be in breach of this agreement and legal action will be taken.
Guests Property: No responsibility is taken for the occupants personal property left at the premises.
Property Description: Our staff will describe the premises and its position to the best of our ability and in good faith. We recommend that you look at the photos on the internet. No responsibility, refund, or relocating for alleged misrepresentation can be accepted.
