Terms & Conditions of your Holiday Rental
In providing booking services Sydney Holiday Rentals Pty Ltd ABN 44 097 622 869 ("SHR") acts as an agent for various property owners and SHR does not accept or undertake any personal liability when acting in this capacity.
Premises are let for holiday purposes/business travel only for the period stated on your letter/receipt from SHR but may be subject to change as in rare cases we may be notified by the owner prior to the commencement of the booking. All advance deposits are accepted on behalf of the current owner, however we will not accept responsibility for decisions, actions or arrangements taken by the current owners of the premises or any other body which is outside our control.
SHR reserve the right to cancel any booking should anything arise, which in our opinion absolutely renders the booking impractical. In either event, we shall notify you as soon as possible and do our best to arrange alternative accommodation or alternative dates suitable, failing which all deposit monies paid will be refunded, but no other claim, right or action shall exist in or be made by either party.
It is our aim at all times to get our clients into their accommodation as soon as possible on the day of their arrival. Check in is generally available from 2pm-6pm daily or after 6pm for an additional charge of $20 + GST. The premises are to be vacated promptly at 10am on the day of departure unless a later departure has been agreed in advance. The purpose of these strict times is to allow the necessary time to clean the premises. Please consider your fellow incoming/outgoing holiday occupants. Car parking at the accommodation is also not available till time of check-in. We cannot allow access for the storage of any items prior to your check in time. Failure to depart before 10am on the day of departure may incur and extra charge which will be 50% of one night’s rental at the rate at which your booking was accepted.
All damage, breakages or losses to the property and/or furniture/furnishings are to be reported to the SHR immediately and may impact the refund of your Bond; for further information see the Bond section below. All furnishings and equipment must be left in the premises as originally found. All properties have a strict NO SMOKING policy (which includes balconies) and no pets are allowed.
Functions and parties on the premises are strictly not allowed. SHR reserves the right to terminate your tenancy immediately if you cause nuisance or annoyance to neighbours or are found to be holding a function or party. Unless stated within the property description, all premises are fully self-contained including linen i.e. sheets, pillowcases, towels, bath mats, tea towels. The premises are not serviced during your stay.
The maximum number of persons permitted to occupy the booked premises overnight will form part of the booking contract and will be nominated when you make your booking. Persons found occupying the premises over and above the number on the booking form will be charged automatically to the security deposit at $500 a day for the term of the booking.
You are required to allow repair and/or service personnel to enter the premises for the purpose of conducting any repair or service deemed necessary by SHR. Such times of entering will be arranged prior where possible and will between the hours of 9:00 AM and 5:00 PM. SHR will, at all times, do it's very best to remedy items that are not operational in a reasonable timeframe. SHR and/or the property owner takes no responsibility for delays in the repair that are outside its control.
A deposit of 30% of the total cost of the booking, inclusive of all services ("Total Rental Cost"), must be received within 3 working days of the reservation being made before a reservation can be confirmed. Failure to do so may result in the reservation being automatically cancelled without notice.
Final payment of the remaining 70% of the Total Rental Cost must be received no later than 14 days prior to the arrival date. Failure to make the final payment on time will result in the booking being automatically cancelled without notice. Payment must be made in full, no part payments can be accepted and the payment must be made by the person whose name the booking is in. When payment is made by direct transfer from one account into another the payee must include name of booking in the details and if possible dates of booking.
Any charge for services to you, not billed at the time of your confirmation will be added to your account for settlement and be charged to the same credit card used as security at the time of arrival.
A Bond (security deposit) applies on all properties and the payment of the designated amount for each property must be made before occupation is allowed. All breakages/damages must be reported to SHR immediately and SHR reserves the right to deduct any appropriate costs from the Bond, request further payment, or process a payment from debit/credit card details held on file to cover the breakages/damage. The charges for breakages/damage are wholly at the discretion of SHR and their assessment of what a fair charge may be. No discussion will be entered into on the value of these charges. All parties consent to these charges being applied in these circumstances by making a confirmed booking.
A 3% merchant fee applies on all debit and credit card transactions. If you wish to avoid paying this fee we accept payments by bank transfer/deposit without charge.
Cancellation of a booking must be in writing by email to Info@SydneyHolidayRentals.com.au. If your cancellation is not acknowledged by return email within 24 hours, which is our standard policy under normal circumstances, your cancellation is deemed not to have been received and you must contact us by phone on 02 8866 3379. Cancellation fees will be charged on confirmed bookings in accordance with the following Cancellation Conditions.
Deposits will only be transferred between properties or applied towards payments for any other properties at the discretion of SHR and the property owner. SHR have no obligation to do so under normal circumstances.
Failure to make final payment on the due date will result in an automatic cancellation of the booking without notice & the following Cancellation Policy will also apply.
Bookings cancelled more than 30 days prior to the arrival date are not subject to a cancellation fee and a full refund of any monies paid will be refunded. Bookings requiring cancellation between 30 days and 8 days prior to the arrival date will incur a cancellation fee of 30% of the Total Rental Cost. Bookings requiring cancellation 7 days or less prior to arrival will incur a cancellation fee of 65% of the Total Renal Cost. All refunds due will be made within 7 days of the confirmed cancellation request by the same payment method by which the original payment was made.
Any cancellations with mitigating circumstances will be considered by SHR and the property owner but neither party are under any obligation to alter the Cancellation Policy as listed above. Mitigating circumstances will only be considered when official documentation to support the request for cancellation can be submitted within 48 hours of the cancellation request.
Changes After Arrival
It is not possible to request to change your property after arrival for any reason. SHR goes to great lengths to ensure all holiday premises are fairly described and accurately photographed. It remains the booking party’s obligation to ensure the premises is fit for their needs before booking using the information available and no refunds will be made after arrival if you are unhappy with your choice. Should you have any questions about whether a property is suitable for your needs we are more than happy to discuss them with you in advance of booking.
SHR reserves the right to charge a $75 + GST amendment fee for booking changes. An amendment to your booking is at the discretion of SHR and is possible where one date of the booking remains the same and the length of stay remains the same or extends.
Under no circumstances can SHR or any of the property owners be held responsible for weather conditions which impact your holiday. Bookings cannot be cancelled other than in accordance with the cancellation policy detailed in this document.
Changes, Responsibility and Further
Conditions - All information in respect of goods & services offered, including prices, is subject to alteration or withdrawal without notice. SHR has the right to alter, amend or cancel all or any arrangements or prices in regard to accommodation. The right to alter prices referred to in the preceding paragraph applies until SHR has received a deposit.
No responsibility or liability is accepted or undertaken by SHR, its employees, agents or contractors for any death, injury, accident, damage to personal property (including baggage) or any other matter arising from any act, omission or thing outside of their control.
In addition to the terms & conditions set out above, any booking is subject to such further terms & conditions as advised at the time of booking or as may be displayed at the time of utilisation of the item or service.
Any provision of, or the application of any provision of, these term & conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or any other jurisdiction.
SHR is dedicated to keeping your details private. Any information, we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone. We use this information to identify your orders, provide you with our monthly newsletter (if applicable) and to personalise your shopping experience with us; that's all.
We do not keep a record of the IP addresses from which users access our site except where you have specifically provided us with information about yourself, in which case we also record your IP address for security purposes. An example of this would be when proceeding to a checkout to finalise an order you may wish to make. After completing the form provided, your IP address will be stored along with a transaction number that allows us to track your order.
When purchasing from SHR your financial details are passed through a secure server using the encryption technology which is provided by the payment processor. You can rest assured your details are safe and secure.
All our prices are in Australian Dollars (AUD) and any GST component is inclusive of the price displayed unless otherwise stated.
SHR recommends you obtain travel insurance. This insurance can protect you against loss of personal belongings, public liability & also against your need to cancel under certain conditions.
