Terms and Conditions
1.1 LICENCE NOT A TENANCY
Guests are granted a limited permission to occupy “Rocky Tops” for holiday purposes;
This is not a residential tenancy agreement and failure to comply with the Guest’s obligations in Terms and Conditions may result in termination of permission to occupy “Rocky Tops” and eviction
1.2 SECURITY DEPOSIT OR BOND
Guests are advised that failure to comply with the Terms and Conditions may result in charges against your security deposit
1.3 NUMBER OF GUESTS
Whilst “Rocky Tops” sleeps 10 comfortably, the Owners reserve all rights to limit this number at their discretion. Visitors of guests are allowed to enter the property but need prior arrangement by the Owners to be accommodated overnight
1.4 GENERAL OBLIGATIONS OF GUESTS AND VISITORS
Guests and visitors must comply with House Rules and respect the residential amenity and security of “Rocky Tops” and its neighbours and community
Guests and visitors must refrain from anti-social behaviour and comply with the Owners or staff during their stay and notify Owners of any disputes or complaints as soon as practicable
1.5 NOISE AND RESIDENTIAL AMENITY
Guests and visitors must not create noise which is offensive to Owners, neighbours, the community throughout the occupancy.
Offensive noise is prohibited any may result in
i. termination of permission to occupy “Rocky Tops”
iii. loss of rental paid and/or bond
iv. extra charges for security and other expenses
Guests and visitors must abide by any noise abatement conditions, standards and orders issued by police or any regulatory authority to minimise impacts upon the residential amenity of neighbours and community.
1.6 FUNCTIONS AND PARTIES
“Rocky Tops” is not a ‘party house’ and any such activities are strictly prohibited and any gathering, celebration or entertainment must be permitted by Owners and not conflict with House Rules.
1.7 DRIVING ON THE PROPERTY AND PARKING
Guests and visitors are to drive any/all vehicle only on designated road/s provided and parking is permitted on gravel section and allocated areas adjacent the house. There is plenty of parking provided at “Rocky Tops”
1.8 GARBAGE AND RECYCLING
Guests and visitors are to dispose of garbage, recycling and rubbish in the bins allocated on premises and not to leave excess rubbish inside or around “Rocky Tops”
1.9 DAMAGES AND BREAKAGES
Guests to report any damage and/or breakages to the Owners and may result in refusal to refund bond monies
Guests with any complaints, problems or incidents are to report to the Owners promptly for resolution
1.11 CONSEQUENCES OF NOT MEETING the TERMS AND CONDITIONS
The consequences of not complying with the Terms and Conditions requirements can include enforcement action from the Owner, Staff, Security Management, Local Council or the Police and
enforcement action is subject to the Australian Consumer Law and other relevant legislation
and can result in termination of permission to occupy “Rocky Tops”, eviction, loss of rental paid, loss or deduction of bond monies paid, even extra charges
It is therefore important for all Guests to be aware of their obligations and of their responsibilities to make all persons, including visitors aware of these requirements to maintain the amenity of “Rocky Tops” and its neighbourhood.
