Nestled in the forest just under the Cape Byron Lighthouse, the studio accommodation provides the most private and secluded guest quarters at Wategos Beach, just 10 minutes from Byron Bay. The Studio is set in lush tropical gardens and is a 3 minute stroll to the world famous sands of Wategos Beach.

This spacious accommodation is truly a unique experience capturing the essence of the Byron lifestyle. Prepare to feel very relaxed and at peace in the 'Treehouse' retreat; a place to recharge and enjoy the presence of your loved one. The loft bedroom offers ocean glimpses and provides a real 'treetops' feel.

Direct access to the beach is down a tree-lined pathway through the public reserve opposite the studio. Byron Bay is just a 5 minute drive away or a 25 minute walk along the Cape Byron Headland track via the Pass, Byron Bays renowned surfing spot.

The studio is available for maximum 2 guests only, seeking peace and quiet close to one of Australia's most famous beaches.

Noise and quiet enjoyment

The apartment is located in a quiet residential area. Noise and behaviour restrictions apply. Noise means any sound that can be heard from neighbouring properties which may disturb their peace and quiet.

The property may not be used for any commercial purposes.  Parties, weddings and other functions are strictly prohibited, as is playing of loud music and anti-social behaviour after 10.00pm. Disturbance to our neighbours, including excessive noise, is prohibited and may result in immediate termination of rental and loss of bond. A $200 deduction will be taken from the security deposit with each security callout for excessive noise

Any extra charges incurred as a result of breach of this condition will be charged against the security bond including calling-out of security, extra cleaning, garbage removal, wear and tear repairs etc.

Reservation

To reserve the Studio, we need a written request indicating dates of arrival and departure plus the intended number of guests. A mobile phone number must be provided and be contactable when occupying the residence, 24/7for security purposes.

The booking will be confirmed on receipt of a 50% deposit, except where arrival is within 30 days of booking, in which case full payment is required. The balance of payment is due 30 days prior to arrival.  If not the Owner has the right to cancel the booking and relet the property. Please check the details of the booking confirmation to make sure they are correct as payment of the rental deposit constitutes the Clients acceptance of these Terms and Conditions.

Payments can be made by bank transfer or if you wish to pay by credit card, by PayPal.  Credit card fees apply – at cost. On clearance of the deposited funds, the booking will be promptly confirmed in writing to the Client by email message.

Cancellation

Unfortunately, last minute cancellations mean lost revenues. Any cancellation must be in writing. The deposit is fully refundable three months before the date of confirmation of your booking and 50% is refundable up to 30 days before occupancy date.

If cancellation is made by the Client, any time after 28 days before date of occupation, the deposit money is not refundable unless the house is re-let for the entire period subject to a cancellation fee of 10% of the rental amount. The owners undertake to make every reasonable effort to relet the property.

Cancellation by Owners

The owners will make every effort to ensure the property is available as booked. However the owners reserve the right to make alterations to bookings due to unforeseen circumstances.  In the unlikely event of us terminating or cancelling the booking because of unusual or unforeseen circumstances beyond our control, then we will refund all money already paid by you, but our liability for compensation would not extend beyond this refund.

Arrival and Departure Times

Check in time is normally after 2.00 pm and check out time is 10.00 am on the agreed day, or by prior arrangement.

Minimum and maximum stay

The minimum rental period is 3 consecutive nights. The maximum rental period is 2 calendar months.

What’s included

The apartment is provided fully furnished and equipped with linen and towels. A cleaning fee of $60 is also required. Additional cleaning and linen changes during your stay can be arranged in advance at a fee.

Cleaning and Garbage

The occupant is required to leave the property in the same clean, neat and tidy condition as it was when they arrived, including washing up of dishes, BBQ and disposal of rubbish. Excess cleaning or removal of excess garbage will be charged against the security deposit.

Garbage is to be placed in the outside bin with the lid closed. Place recyclable rubbish in the yellow bin only. Bins to be placed out for collection on Sunday night. No surplus rubbish is to be left on the street or on the property.

Party Size

The number of persons using the accommodation must not exceed the maximum number stated in the rental agreement, namely, 2 adults. The studio is not suitable for small children. The names and home addresses of all guests must be provided with the booking form.

We do not rent to young adult school leavers during the end of final year  “schoolies” weeks and an y booking made on their behalf will be declined and deposits returned.

Pets and Smoking Policy

The apartment has a “no pets” and a “no smoking” policy.

Security Bond.

The Client will protect the property, its furniture and fittings, from damage and the property should be left in a similar state to its condition on arrival. 

A Security Deposit of $300 is payable with payment of the balance rental due before or on arrival. This will be refunded within 14 days of departure and after satisfactory inspection. The security deposit will be used in part or full in the case of breakages, damage to the apartment, its furniture and fittings, excess cleaning or garbage removal charges, loss of a key or extra guest beyond those declared.

Liability

The tenant and members of their party cannot under any circumstance, hold the owner responsible for any and all personal injuries, damage to apartment during rental, or theft arising out of or connected in any way to your rental of our property.

Travel Insurance

Travellers are strongly advised to take out a comprehensive travel insurance policy before departure to cover themselves in the event of cancellation, loss of deposit and flight bookings, damage to property or theft.

Jurisdiction

All eventual disagreements or disputes will be governed by NSW law.

Breach of terms

The Owners or their representative reserve the right to refuse admittance or terminate the booking without compensation if these terms and conditions are not observed.

Just in case you haven't been here before, Wategos Beach is about 2.5km east of Byron Bay, directly under the Cape Byron Lighthouse. Drive east from the centre of Byron Bay town along Lawson Street and Lighthouse Road and after about 2.5km take the left side of the "V" fork in the road down to Wategos Beach instead of the upper road to the Lighthouse.

Wategos Beach is a cul-de-sac and once there, you can’t get lost. We are located at No. 31 Brownell Drive which is on the high side of Wategos Beach directly in the middle. The studio is located directly above the garage on the street, with the studio access at the rear. The garage is a shingled roof semi-circular building right on the road and is quite distinctive, with a number 31 marked on the kerb.

Parking is on street and please park your car as close to No. 31 as you can but leaving the garage driveway clear.  A Visitor Parking Permit will be available for you on arrival
